California structural pesticide use report and the §8538 notice

In California, every registered structural pest control company sends the county agricultural commissioner a monthly report of all pesticides used in that county, due by the 10th of the following month (Business and Professions Code §8505.17(c)). It lists each pesticide’s name, registration number and the amount used, on a form approved by the Department of Pesticide Regulation. A month with no work still needs a report saying so, and the company keeps a copy for 3 years. Before treating, the company gives the owner and tenant a written notice (§8538).

What goes on the monthly report

The statute asks for each pesticide’s name, registration number and amount used. The DPR regulation (3 CCR §6627) also lists:

  • Name and address of the company that applied the pesticides
  • County where the work was done
  • Month and year of use
  • Site treated, or the use code from the report form
  • Each pesticide with its EPA or state registration number and the amount used

Number of applications

Since 2015 the statute no longer asks structural companies for the number of applications, and DPR’s policy since October 1, 2016 is not to require it on structural monthly reports, even though §6627 still mentions it.

Deadlines and records

  • Due to the county agricultural commissioner by the 10th of the month after the work. If mailed, the postmark is the delivery date
  • One report per county where the company did work
  • A month with no pest control in a county where the company is registered: a report saying so, with no stamp needed
  • Each report carries a pesticide use stamp or stamp number from the Structural Pest Control Board as the filing fee
  • The company keeps a copy for 3 years after it is submitted

The notice before treatment (§8538)

The owner (or agent) and the tenant get a clear written notice with the pest, the pesticides and active ingredients, the caution statement and phone numbers the statute prescribes (the company, county health department, county agricultural commissioner and the Structural Pest Control Board), and the treatment frequency under a periodic contract. Branch 1 (fumigation) notices go out at least 48 hours ahead; Branch 2 and 3 notices before the application. It can be mailed, emailed, posted in a conspicuous place or handed over, and commercial buildings also get a posted notice unless the owner objects. Under a periodic contract it is given at the first treatment, and again if the pesticide changes.

Common questions

Do I still report how many applications I made?

Not on structural monthly reports. The statute dropped it in 2015 and DPR stopped requiring it in 2016. Ask your county if its form still has the column.

Is the signed service report the §8538 notice?

No. The notice comes before the work and carries wording the statute prescribes. The service report is the record of what was done.
